Preliminary note
As a provider of hosting services, Darkmatter IT (sole proprietorship), brand “MAM-JAHN”, is subject to Regulation (EU) 2021/784 on addressing the dissemination of terrorist content online. This page describes how authorities and users can draw our attention to terrorist content and how we deal with it.
Point of contact for removal orders
(1) Please send removal orders from the competent authorities, and enquiries about them, to support@mam-jahn.de (subject: “TCO Entfernungsanordnung”). Communication is possible in German and English.
(2) We remove terrorist content that a removal order refers to, or disable access to it in all Member States, without undue delay and at the latest within one hour of receipt of the order. We confirm execution to the authority.
(3) This point of contact is intended for orders and notices about terrorist content. Please send general enquiries to support (support@mam-jahn.de).
Notices from users
(1) If you discover terrorist content on a service hosted by us, please report it to support@mam-jahn.de (subject: “TCO Hinweis”). State the exact location (URL or IP address) and, if possible, a brief reason. You may also report anonymously; with your contact details we can ask follow-up questions.
(2) We examine the notice without undue delay. If it is confirmed, we remove or block the content, even without a removal order.
(3) The procedure and legal remedies for reports under the Digital Services Act are described on the page https://mam-jahn.de/dsa/.
What counts as terrorist content
Under the Regulation, terrorist content is in particular material that calls for, solicits, instructs or trains for the commission of terrorist offences (such as instructions for making explosives or weapons for such acts), calls for participation in the activities of a terrorist group or glorifies offences of this kind. The authoritative definition is in Art. 2 of Regulation (EU) 2021/784.
Measures and information of content providers
(1) We may remove terrorist content or block access to it, block the customer account and terminate the contract without notice (§ 7 of the Terms and Conditions).
(2) We inform the content provider, i.e. our customer whose content was removed or blocked, about the removal or blocking and its reason and point out their legal remedies, unless the authority has prohibited this because of ongoing investigations.
(3) Anyone affected by a removal or blocking can lodge a complaint with us and request restoration (support@mam-jahn.de, subject: “TCO Beschwerde”). We examine the complaint and tell you the result. Against an official removal order, the content provider has the legal remedies available under the law of the ordering Member State.
